The Cherry County Board of Commissioners special meeting for the purpose of holding a public hearing regarding CUP 003/18 submitted by BSH Kilgore, LLC is postponed until such time as the district court judge issues a ruling regarding Case #CI 19-44 in the District Court of Cherry County.

On Monday, July 15th, District Judge Mark Kozicek granted a temporary stay in a lawsuit against Cherry County and the three sitting commissioners. The suit was filed by the group Preserve the Sandhills. Attorneys for Preserve the Sandhills filed the injunction on July 5th in District Court in an effort to stop the public hearing scheduled for Tuesday the 16th. The judge granted the temporary stay which alleges a conflict of interest by Commissioners Storer and DeNaeyer. Judge Kozicek sought more time to review the case.
