The Cherry County Commissioners waded through over 30 property tax
protests before they could tackle the legal update from County Attorney
Eric Scott concerning the zoning investigation of a conditional use permit
for the Kilgore Wind Project.  Mr. Scott reported that he had found a
couple of areas of concern with the investigation report. Two of those
issues would be the statement from NPPD indicating they would not purchase
the power and that the developers bank account was not set up in the
county’s name, for decommissioning. He stated that all the evidence has
not been obtained.

Carolyn Semin brought a point of order when Chairman Mike McConaughey
brought up going into closed session to discuss possible litigation.  Mrs.
Semin expressed that the potential or threat of litigation did not give
the commissioners the right to use closed session. Eric Scott argued that
it did, if the commissioners so desired.
 Chairman McConaughey said he would then ask his question in open session.
He asked Mr. Scott if he could defend the county if there were to be
litigation. Mr. Scott replied he would not have a problem. No action was
taken.
About 15 to 20 people attended the meeting.
