The Nebraska Supreme Court has upheld the convictions and sentences of 29 year-old Kevin Kilmer.

A jury found Kilmer guilty in August 2023 for the 2021 murder of 52-year-old Ruth Wittmuss, which occurred in Kilgore.

He was later sentenced in Cherry County District Court to life in prison for 1st Degree Murder and an additional 10-14 years for use of a weapon to commit a felony.

Kilmer filed an appeal afterwards, arguing there wasn’t enough evidence to support the murder conviction.

The state’s high court disagreed, saying beyond a resonable doubt, that Kilmer had acted with deliberate and premeditated malice. 

The court then affirmed Kilmer’s convictions and sentences on Friday, December 6.
