The Brown vs. Cherry County case will proceed, but not in Cherry County. The case was filed in in Cherry County District court of appeals in response to a CUP Permit approved by the Cherry County Board of Commissioners to allow the construction of a swine facility in north central Cherry County by Danielski Harvesting and Farming, LLC. Judge Kozicek recused himself from the case due to a possible conflict of interest, and so the case will be conducted in Broken Bow, Nebraska at the Custer County Judicial Center. The trial is scheduled for 4 days beginning September 25th at 9:30am, Judge Karin Noakes presiding.
