The Nebraska Supreme Court issued its second ruling concerning wind development in Cherry County in as many weeks. In the case of Preserve The Sandhills versus Cherry County for issuing a conditional use permit for a wind farm near Kilgore, the Court ruled in favor of Cherry County. This was an appeal from District Court for Cherry County with Mark Kozisek presiding. No less than 12 attorneys are listed in the court documents as participating in the case. The Supreme Court stated “the appeal fails to establish the Preserve the Sandhills and Reiser-McCormick timely perfected their CUP appeal in the district court. As such the court agreed with the district courts conclusion that it lacked jurisdiction of the CUP appeal. The case was dismissed for
lack of jurisdiction by the Nebraska Supreme Court. The documents were filed on March 3rd.
