On Friday, November 12th, District Judge Mark Kozicek dismissed a third of three lawsuits filed by Preserve The Sandhills and Charlene Reiser McCormick, against Cherry County, the county commissioners and entities interested in pursuing wind energy development in the county. The suit complained that the commissioners erred when granting the Conditional Use Permit for Bluestem Sandhills Kilgore to build a wind farm Southwest of Kilgore. In the judge’s ruling, Kozicek stated that “Preserve The Sandhills does not own property or pay taxes in Cherry County therefore there is no evidence it would suffer any direct injury as a result of the defendants actions”. There could be an appeal by Preserve The Sandhills.
