Thursday August 8th, in the District Court of Cherry County Judge Mark Kozisek issued an order denying the temporary injunction lawsuit filed by Preserve the Sandhills and Charlene Reiser McCormick against Cherry County and the county commissioners. The injunction was filed on July 15th to allow time for the judge to review the evidence. On August 8th the judge filed an order stating ”the plaintiffs motion for temporary injunction is overruled and denied, The temporary order entered July 15th in vacated and dissolved and the matter is set for Progression Conference on August 27th at 10:30.
The suit was filed one day before the county commissioners were set to hold a public hearing on a conditional use permit for a wind farm in the Kilgore area. The suit stated a conflict of interest by Martin Denaeyer and Tanya Storer. The Nebraska Accountability and Disclosure Commission cleared both commissioners in 2016 and 2017 from any conflicts and were not advised to remove themselves from any decision on the matter.
